An Australian Business Visa must not be confused with the Skilled Visa or Employer Sponsored Visa; the three visas relate to work but are all quite different.

If you are an individual with a particular skill that Australia needs, you should apply for a Skilled Visa to migrate. A Skilled Visa aims to benefit Australia’s economy and improve the workforce, by giving you the opportunity to bring your needed skill into the country.

If you are not looking to establish a business, but you seek to work as an employee within an Australian company, you would need an Employer Sponsored Visa. This type of visa allows Australian businesses to sponsor you as a skilled worker with recognised qualifications.

As a professional migrant that wishes to establish a business in Australia, you will need an Australian Business Visa. On an Australian Business Visa, you would be investing in the economy and providing work for Australian residents.

Subcategories of  Australian Business Visas

• Business Talent Visa (Subclass 132)

• Business Innovation Stream Visa (Subclass 188)

• Business Investor Stream Visa (Subclass 188)

• Significant Investor Visa (Subclass 188)

Business Talent Visa

You would be looking at a Business Talent Visa if you wish to introduce a new business to Australia, or develop an existing operation. This Australian Business Visa subclass specifically seeks high calibre business individuals with money to invest. If you fall into the Australian Business Talent Visa category, be aware it is split into two streams;

• Significant Business History – if you are an experienced professional that owns an existing business (or co-owns) and wishes to bring that business to Australia.

• Venture Capital Entrepreneur – if you have obtained venture capital for a business from a member of the Australian Venture Capital Association Limited (AVCAL).

There are certain requirements you must meet within this particular Australian Business Visa, for example (but not limited to);

• You must be younger than 55 years of age (although this can be waivered under certain conditions).

• You must not have outstanding debts to the Australian Government.

To apply for the Significant Business History stream of this Australian Business Visa, you will need to prove substantial assets and sufficient monetary turnover. For example, you’ll need to have an annual turnover of at least AUD 3 million in at least two of the four years before you apply for your Australian Business Visa. This turnover could be from one main business or two of your businesses combined.

The Venture Capital Entrepreneur stream falls under the same Australian Business Visa subcategory, but is considerably different. You would apply for the Venture Capital Entrepreneur stream if you have successfully obtained funding of at least AUD 1 million from an Australian Venture Capital.

Business Innovation Stream Visa

If you wish to start up a new business in Australia, or invest in an existing, you may fall under the Business Innovation Visa . Bear in mind that this type of Australian Business Visa is only temporary but can lead to permanent residence over a period of time.

The Business Innovation Visa calls for you to invest in an Australian business for a period of four years. There is a points system (the ‘innovation points test’) within this Australian Business Visa category, in which you must score at least 65. Your asset value and annual business turnover is also taken into account.

Business Investor Stream Visa

Looking to invest in a new or existing Australian business? Depending on your monetary investment, you may fall under the Business Investor Visa stream. This Australian Business Visa is similar to the Innovation Visa; it is temporary, you must be willing to invest for a period of 4 years, and you must undergo a points test. However, the Business Investor Visa allows you to manage your investments in an Australian business, of at least AUD 1.5 million.

Significant Investor Visa

You would apply for the Significant Investor Visa , which falls under the under the Business Innovation and Investment class if you have at least 5 AUD million complying investments, for a minimum of 4 years.

This type of Australian Business Visa can be applied for as a provisional or a permanent visa. You do not need to qualify under the points test nor fall into a specific age gap, but you do need to lodge an Expression of Interest, and receive a nomination by a State or Territory Government.

The Significant Investor Visa does not require an English language proficiency per se, but you would need to demonstrate the ability to speak English if you wish to avoid additional Australian Business Visa charges.
